These Terms of Service ("Terms") govern your use of the website and services provided by David Hacker ("we," "us," or "our"), including consulting services, emergency support, appointment scheduling, and related communications. By accessing our website or using our services, you agree to these Terms.

1. Services

David Hacker provides NICE CXone consulting, contact center engineering, and emergency technical support services. Our services include:

• Free 30-minute strategy consultations (booked via our scheduling system).
• Emergency support calls billed at $250/hour in 15-minute increments.
• Custom consulting and engineering engagements as separately agreed upon.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use our services. By using our services, you represent that you meet these requirements.

3. Bookings & Scheduling

• Meeting bookings are subject to availability.
• Same-day bookings must be made at least 2.5 hours in advance and after 12:00 PM ET.
• We reserve the right to cancel or reschedule any booking at our discretion.
• You agree to provide accurate contact information when booking.

4. Emergency Support & Billing

• Emergency support is available Mon–Fri, 9 AM–5 PM ET. After-hours availability varies.
• By using our emergency support service, you authorize us to save your payment method on file and charge it after the call based on actual time used.
• Billing begins when both parties are connected and is rounded up to the next 15-minute increment at $250/hour.
• All charges are processed through Stripe. You agree to Stripe's terms of service.
• Emergency sessions expire 24 hours after creation if not used.

5. Payment Terms

• All fees are in US dollars.
• Payment is due upon completion of emergency support sessions.
• For custom engagements, payment terms will be outlined in a separate agreement.
• Refund requests are handled on a case-by-case basis. Contact us at me@davidhacker.com for refund inquiries.

6. SMS & Communications

By providing your phone number, you may receive SMS messages related to your bookings, emergency call coordination, and service updates. See our SMS Terms & Conditions and Privacy Policy for full details on messaging.

7. Intellectual Property

All content on this website, including text, design, code, and branding, is the property of David Hacker and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without prior written consent.

8. Call Recording

Emergency support calls may be recorded for quality assurance, billing verification, and reference purposes. By using our emergency support service, you consent to the recording of calls.

• Recordings, when available, may be accessible through your client portal for a limited time.
• We do not guarantee the availability or retention of any call recordings. Recordings may be deleted at any time without notice.
• If you require a permanent copy of a call recording, you are responsible for downloading it while it is available.
• Recording availability is subject to storage limits and may be removed to manage capacity.

9. Confidentiality

Information shared during consulting and support sessions is treated as confidential. We will not disclose your business information to third parties without your consent, except as required by law. This does not constitute a formal non-disclosure agreement — if you require an NDA, please request one before sharing sensitive information.

10. Limitation of Liability

To the maximum extent permitted by law:

• Our services are provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
• Our total liability for any claim related to our services shall not exceed the total amount you paid to us in the 12 months preceding the claim.
• We do not guarantee specific outcomes from consulting or support services.

11. Indemnification

You agree to indemnify, defend, and hold harmless David Hacker from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services or violation of these Terms.

12. Termination

We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination will survive.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Hillsborough County, Florida.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
